Legal Bases of the Draw "Boots MOU"

The company Il Baco Da Seta, with registered office at C/ Conde Salvatierra, 34 valencia and NIF B98949423, hereinafter "the Company", organizes the draw called "Boots Raffle Mou", hereinafter "the Sweepstakes", with the objective of promoting participation and gaining followers on the Company's Instagram account.

 

1. Conditions of Participation:

1.1 All people over 18 years of age, legal residents of Spain, who make a purchase of any product in the Company's online store during the participation period may participate in the Draw.

1.2 Company employees and their immediate family members are excluded from participation.

 

2. Draw Duration:

The participation period in the Sweepstakes will begin on October 3, 2024 and will end on October 17, 2024.

 

3. Participation Mechanics:

3.1 To participate in the Sweepstakes, customers must make a purchase in the Company's online store during the participation period.

3.2 Each purchase made during the participation period will count as one entry in the Draw, regardless of the value of the purchase ticket.

3.3 The Company reserves the right to disqualify entries that are fraudulent, incorrect or do not comply with the requirements established in these legal bases.

 

4. Award:

4.1 Prize: The prize consists of a pair of Boots Mou at the winner's choice within the store catalog, subject to the availability of sizes at the time of the election.

4.2 The prize is personal and non-transferable and cannot be exchanged for its cash value or for any other prize.

4.3 In the event that the selected model or size is not available, an alternative model of equal or greater value will be offered within the store catalog.

 

5. Winner Selection:

5.1 The winner will be selected at random through the PineRaffle application on October 17, 2024.

5.2 The selection of the winner will be recorded and documented to ensure the transparency of the process.

5.3 The winner will be contacted by email at the address provided during the purchase process within a maximum period of 15 business days from the selection of the winner.

 

6. Winner Communication:

6.1 The winner will be announced on the Company's website and social networks, provided that the winner has given his or her consent to do so.

6.2 If the winner does not respond within 30 business days of the first contact attempt, a new winner will be selected using the same random selection process.

 

7. Protection of Personal Data:

7.1 Participation in the Sweepstakes implies acceptance of the Company's privacy policy and the processing of participants' personal data in accordance with European data protection regulations (General Data Protection Regulation - GDPR).

7.2 Responsible for the Treatment: Il Baco Da Seta, with address at Calle Isabel la Católica 16 Valencia, will be responsible for the processing of personal data collected during participation in the Sweepstakes.

7.3 Purpose of Processing: Personal data is collected for the sole purpose of managing participation in the Draw, communicating the result to the participants, and, where appropriate, delivering the prize. Additionally, the data may be used to send commercial information about the Company's products and promotions, provided that the participant has given their express consent to do so.

7.4 Legitimation: The legal basis for the processing of personal data is the consent of the participant, granted when making the purchase and participating in the Draw.

7.5 Conservation of Data: The personal data of the participants will be kept for the time necessary to manage the Sweepstakes and, once finished, will remain blocked during the limitation period for any legal actions that may arise. If you have given your consent to receive commercial communications, the data will be kept until the participant requests to unsubscribe from said shipments.

7.6 Participant's Rights: Participants may exercise their rights of access, rectification, deletion, limitation of processing, portability and opposition, by sending a written request to the email address ilbacodaseta@gmail.com or by postal mail to the address mentioned above. If the participant considers that their rights have not been duly respected, they have the right to file a claim with the Spanish Data Protection Agency (www.aepd.es).

7.7 Data Transfer: Personal data will not be transferred to third parties, except under legal obligation, nor will they be transferred outside the European Economic Area.

9. Applicable Law and Jurisdiction:

9.1 These legal bases are governed by Spanish legislation.

9.2 For any dispute that may arise from the interpretation or execution of these bases, the parties submit to the jurisdiction of the courts and tribunals of Valencia, expressly waiving any other jurisdiction that may apply to them.
