LEGAL BASES OF THE "BOOTS" DRAW MOU" ON INSTAGRAM

The company Il Baco Da Seta, with registered office at C/ Conde Salvatierra, 34 valencia and NIF B98949423, hereinafter "the Company", organizes the draw called "Boots Raffle Mou", hereinafter "the Sweepstakes", with the objective of promoting participation and gaining followers on the Company's Instagram account.

1. Conditions of Participation:

1.1 All persons over 18 years of age, legal residents of Spain, who follow the participation instructions published on the Company's Instagram account during the participation period, may participate in the Draw.
1.2 Company employees and their immediate family members are excluded from participation.

2. Duration of the Draw:

The period of participation in the Sweepstakes will begin on October 3, 2024 and will end October 17, 2024 at 11:59 p.m. (CET).

3. Participation Mechanics:

3.1 To participate in the Giveaway, users must meet the following requirements in the official publication of the Giveaway on Instagram:

  • Like the post.
  • Follow the Company's Instagram account.
  • Mention friends in the comments (each mention will count as an additional participation).
  • Share the post on your Instagram stories tagging the Company account.

3.2 The Company reserves the right to disqualify entries that are fraudulent, incorrect or do not comply with the requirements established in these legal bases.

4. Prize:

4.1 Award: The prize consists of a pair of Boots Mou at the winner's choice within the store catalog, subject to the availability of sizes at the time of the election.
4.2 The prize is personal and non-transferable and cannot be exchanged for its cash value or for any other prize.
4.3 In the event that the selected model or size is not available, an alternative model of equal or greater value will be offered within the store catalog.

5. Winner Selection:

5.1 The winner will be selected at random through a random drawing tool on Instagram, on the day October 17, 2024.
5.2 The selection of the winner will be broadcast live on Instagram to guarantee the transparency of the process.
5.3 The winner will be contacted through a private message on Instagram within a maximum period of 48 hours after selection.

6. Winner Communication:

6.1 The winner will be announced live during the draw broadcast on the Company's Instagram account and will be contacted by private message.
6.2 If the winner does not respond within a period of 48 hours From the first contact attempt, a new winner will be selected through the same random selection process.

7. Protection of Personal Data:

7.1 Participation in the Sweepstakes implies acceptance of the Company's privacy policy and the processing of participants' personal data in accordance with European data protection regulations (General Data Protection Regulation - GDPR).
7.2 Responsible for Treatment: Il Baco Da Seta, with address at [company address], will be responsible for the processing of personal data collected during participation in the Sweepstakes.
7.3 Purpose of Treatment: Personal data is collected for the sole purpose of managing participation in the Sweepstakes, communicating the result to participants and, where appropriate, delivering the prize. Additionally, the data may be used to send commercial information about the Company's products and promotions, provided that the participant has given their express consent to do so.
7.4 Legitimation: The legal basis for the processing of personal data is the consent of the participant, granted by following the participation instructions on Instagram.
7.5 Data Conservation: The personal data of the participants will be kept for the time necessary to manage the Sweepstakes and, once finished, will remain blocked during the statute of limitations for any legal actions that may arise. If you have given your consent to receive commercial communications, the data will be kept until the participant requests to unsubscribe from said shipments.
7.6 Participant Rights: Participants may exercise their rights of access, rectification, deletion, limitation of processing, portability and opposition by sending a written request to the email address [Company email] or by postal mail to the address mentioned above. In the event that the participant considers that their rights have not been duly respected, they have the right to file a claim with the Spanish Data Protection Agency (www.aepd.es).
7.7 Data Transfer: Personal data will not be transferred to third parties, except under legal obligation, nor will they be transferred outside the European Economic Area.

8. Exoneration of Liability:

8.1 Instagram Exoneration: This giveaway is in no way sponsored, endorsed, administered by or associated with Instagram.
8.2 Use of the Brand Mou: Any mention of the brand Mou is made solely for the purpose of describing the prize being offered in the Sweepstakes. Il Baco Da Seta does not claim any affiliation, association or endorsement by Mou and agrees not to use the brand in a way that may lead to confusion among participants or the general public.

9. Applicable Law and Jurisdiction:

9.1 These legal bases are governed by Spanish legislation.
9.2 For any dispute that may arise from the interpretation or execution of these bases, the parties submit to the jurisdiction of the courts and tribunals of Valencia, expressly waiving any other jurisdiction that may apply to them.
